Family Farms Forever LLC, doing business as Farmooly, reserves the right to modify or remove any content on our app that does not adhere to our content guidelines or that we deem inappropriate for any reason. We will make every effort to notify the user who posted the content of any removal or modification, but we are not obligated to do so.

We also reserve the right to remove or deactivate accounts that are inactive for an extended period or that were registered but never completed (e.g., incomplete vendor or customer profiles with no activity). We will make reasonable efforts to notify account holders before any such removal, though we are not obligated to do so. Users may reactivate or re-register at any time.

  • Access and Update: You have the right to access and update your personal information at any time through your account profile.

Marketplace Facilitator Role: Family Farms Forever LLC, doing business as Farmooly, may operate as or be considered a marketplace facilitator and may be responsible for collecting and remitting sales taxes on transactions conducted through our app, in accordance with applicable state and local laws.

Vendor Responsibilities: Vendors are required to provide accurate and complete information regarding their products and services to ensure the correct calculation of sales taxes. Vendors must also comply with all relevant tax laws and regulations in their respective jurisdictions.

Liability for Tax Miscalculations: Family Farms Forever LLC, doing business as Farmooly, is not liable for any errors in tax calculations resulting from inaccurate or incomplete information provided by vendors. Vendors agree to indemnify and hold harmless Family Farms Forever LLC from any claims or liabilities arising from such errors.

Compliance with State Laws: Vendors acknowledge that sales tax laws vary by state and locality. It is the vendor's responsibility to understand and comply with the tax obligations specific to their business operations.

Changes in Tax Collection Responsibilities: Family Farms Forever LLC, doing business as Farmooly, reserves the right to modify its tax collection and remittance practices in response to changes in laws or regulations. Vendors will be notified of any such changes that may affect their responsibilities.

🚫 10. Vendor Eligibility

Farmooly is a platform intended to support genuine farmers and vendors offering products and services relevant to farmers markets. If any individual or entity registers as a farmer or vendor but is not a legitimate business in the trade of selling such relevant goods or services, Family Farms Forever LLC, doing business as Farmooly, reserves the right to immediately remove the offending account without prior notice. This policy is in place to protect the integrity and trust of our marketplace community.

🥗 11. Use of SNAP Benefits

Family Farms Forever LLC, doing business as Farmooly, supports the use of Supplemental Nutrition Assistance Program (SNAP) benefits to help increase access to fresh, healthy, and locally grown food.

User Responsibilities:

  • SNAP benefits must only be used for eligible food items, as defined by the United States Department of Agriculture (USDA).
  • Users are solely responsible for ensuring that their purchases comply with SNAP guidelines and may not attempt to use SNAP funds for non-eligible products or services.
  • Attempting to misuse or fraudulently use SNAP benefits may result in immediate suspension or termination of your account and may be reported to the appropriate authorities.

Vendor Responsibilities:

  • Vendors who accept SNAP must clearly identify eligible products and ensure proper reporting and compliance with federal and state SNAP regulations.
  • SNAP transactions must be processed using approved methods and devices as required by the USDA or the relevant market authority.

Farmooly Oversight:

  • Family Farms Forever LLC, doing business as Farmooly, reserves the right to review and audit SNAP-related transactions for compliance purposes.
  • We may suspend or terminate access to SNAP-related features if we detect misuse, non-compliance, or suspicious activity.

By using SNAP benefits on the Farmooly platform, users and vendors acknowledge and agree to comply with all applicable rules and regulations, and accept the consequences of non-compliance.

🌿 12. Cottage Food Laws — Vendor Responsibility and Disclaimer

Farmooly supports small-scale food producers, home cooks, and cottage food vendors who sell locally produced foods. However, the sale and shipping of cottage food products is governed by a complex patchwork of state and local laws that vary significantly across the United States.

Vendor Responsibility:

  • Vendors are solely responsible for understanding and complying with all applicable cottage food laws in their state, including but not limited to: permitted food categories, labeling requirements, revenue caps, licensing or permit requirements, and restrictions on selling online or shipping across state lines.
  • Many states prohibit the interstate shipping of cottage food products. By enabling shipping on your Farmooly profile, you represent and warrant that you have verified your products are legally permitted to be shipped to the states where your customers are located.
  • Some states restrict cottage food sales to direct, in-person transactions at the vendor's home or at farmers markets. It is your obligation to understand whether online sales are permitted in your jurisdiction.

Farmooly Disclaimer and Hold Harmless:

  • Family Farms Forever LLC, doing business as Farmooly, does not provide legal advice and makes no representations regarding the legality of any vendor's products or sales methods in any jurisdiction.
  • Farmooly is a technology platform that facilitates connections between buyers and sellers. Farmooly is not the seller or producer of any food products listed on the platform.
  • By listing cottage food products on Farmooly, vendors agree to indemnify, defend, and hold harmless Family Farms Forever LLC, its officers, employees, agents, and assigns from any and all claims, liabilities, damages, fines, penalties, or expenses (including attorneys' fees) arising out of or related to the vendor's failure to comply with applicable cottage food laws, food safety regulations, or any other laws governing the production, labeling, sale, or shipment of food products.
  • Farmooly reserves the right to remove any listing or suspend any account that it believes may be in violation of applicable law, at its sole discretion, without prior notice.

  • Vendors are encouraged to consult their state's Department of Agriculture website or a qualified attorney for guidance on cottage food laws applicable to their business.
  • A general reference guide to cottage food laws by state can be found through resources such as the National Conference of State Legislatures (NCSL) or the Forrager Cottage Food Law Guide.

🌟 13. Universal Loyalty Points Program — Vendor Participation

All vendors who list products or services on the Farmooly platform agree, as a condition of participation, to accept Farmooly Reward Points as a valid form of partial payment at checkout.

Universal Earn & Redeem: Customers earn Farmooly Reward Points on every qualifying purchase from any participating vendor. Points can be redeemed toward future purchases from any Farmooly vendor — not only the vendor the points were originally earned from. This universal program is modeled after successful multi-vendor loyalty networks and is designed to drive repeat visits and cross-vendor discovery across the local food ecosystem.

Vendor Agreement: By registering as a vendor on Farmooly and listing products, vendors acknowledge and agree that:

  • They will honor customer point redemptions as presented at checkout.
  • Farmooly will adjust the net payout to the vendor to account for any points-based discount applied, in the same manner as other platform discounts.
  • The universal loyalty program is a core platform feature, not an opt-in benefit, and cannot be disabled on a per-vendor basis.
  • Participation in the loyalty program is a material benefit to vendors in the form of increased customer acquisition, platform-wide marketing, and repeat-visit incentives that would otherwise cost the vendor significantly more to replicate independently.

Farmooly Role: Farmooly manages the points ledger, calculates earned points at purchase, and applies redemptions at checkout. Farmooly does not charge vendors separately for the loyalty infrastructure.

🎂 14. Birthday Rewards Program

Farmooly offers a Birthday Rewards Program to celebrate customers on their birthday. Customers who have provided a birthday date in their profile are eligible for:

  • 5× Points Multiplier: On the customer's birthday, all qualifying purchases earn five times the normal Farmooly Reward Points. The multiplier is applied automatically at checkout when the customer's birthday is on file and matches the current date.
  • Vendor Birthday Freebies: Individual vendors may offer a complimentary birthday item (e.g., a free coffee, pastry, or small produce bundle) to customers on their birthday. These vendor-specific offers are managed by the vendor in the Farmooly discounts section and are subject to each vendor's availability and terms.
  • Welcome Signup Bonus: All new customers receive 50 Farmooly Reward Points upon completing their account registration, as a one-time welcome gift. These points are credited automatically and can be used toward any qualifying purchase.

Customer Consent: By providing a birthday date, customers consent to Farmooly storing this information and using it solely to administer the Birthday Rewards Program. Birthday data is not shared with third parties.

Vendor Participation: Vendor birthday freebies are entirely optional and at the vendor's discretion. Farmooly does not guarantee availability of vendor-specific birthday offers.
